One of the biggest sources of stress for homeowners planning a renovation is navigating the local council approval process. The rules can seem complex, but understanding the three main pathways is the key to a smoother project. Here’s a simple breakdown for Sydney homeowners.
1. Exempt Development
This is for very minor projects that have a low impact. If your project meets strict, pre-defined standards, you don’t need council approval at all.
Examples: Building a small deck (under certain size/height limits), a garden shed, a BBQ area, or minor non-structural interior alterations.
Key Benefit: No waiting, no council fees. You just need to ensure your plans comply perfectly with the State Environmental Planning Policy (SEPP).
2. Complying Development Certificate (CDC)
This is a fast-tracked approval pathway for straightforward projects that meet a clear set of code-based standards. A CDC can be issued by a private certifier or your local council, often much faster than a full DA.
Examples: Many single-storey extensions, new swimming pools, first-floor additions (in some cases), and larger-scale internal renovations.
Key Benefit: Much faster than a DA (often just weeks). It’s a clear, black-and-white assessment.
3. Development Application (DA)
A DA is the most comprehensive application, assessed by your local council. You will need a DA if your project doesn’t meet the criteria for Exempt or Complying Development. This is common for projects on heritage-listed properties, in conservation areas, or for large-scale works that might impact neighbours.
Examples: Large second-storey additions, projects that breach standard height or boundary setbacks, or work on a heritage-listed home in Balmain or Rozelle.
Key Benefit: Allows for more complex and unique designs that don’t fit the “one-size-fits-all” CDC codes.
